Limited Warranty for Superior Professional Vehicles
Superior Coaches ("Superior") warrants each Superior body, and other parts manufactured by Superior and added to an automotive chassis, to be free from defects in material and workmanship, under normal use and service, for a period of forty-eight (48) months (unless extended or limited further below), or fifty thousand (50,000) miles on the authorized chassis, whichever occurs first, from the date of first retail purchase from an authorized Superior dealer.
1. Warrantor:
This warranty is granted by Superior Coaches, 2550 Central Point Parkway, Lima, Ohio 45804. No Superior dealer has authority to change or modify this warranty in any respect.
2. Parties to Whom Warranty is Extended:
This warranty shall be extended to any purchaser (other than for purpose of resale) and any legal transferee to whom such product is transferred during the warranty period except as limited below.
3. Items Not Covered:
Superior is a manufacturer of funeral coach bodies, limousine bodies and specialty vehicle products, mounted on chassis manufactured separately and expressly warranted by other manufacturers. This warranty does not, therefore, extend to nor cover any portion of the vehicle, nor contents thereof, which has been separately warranted by another manufacturer; or manufactured by a manufacturer other than Superior except to the extent specifically required by any applicable Federal law or regulation. Superior does not warrant the automotive chassis. Any and all parts supplied with the automotive chassis by the chassis manufacturer are strictly not covered by Superior. These include, but are not limited to, engine, transmission, air conditioner, heater, brakes and factory body. Consult the chassis manufacturer's warranty with regard to those items. Superior will reasonably assist the buyer to assure that the chassis manufacturer honors its warranty obligations but Superior accepts no liability for it. With regards to parts manufactured by others, which carry their own manufacturer's warranty (such as TV's, video players, telephones, audio systems, batteries, tires, etc.), Superior warrants proper installation only. Superior has provided purchasers with copies of the warranties for those items, which include procedures on how to obtain, warranty service; purchasers should follow those procedures should any warranty claim arise.
- Damage or defects due to the installation of equipment by anyone other than Superior factory personnel.
- Damage or deterioration due to normal use, wear and tear or exposure.
- Normal maintenance services such as, but not limited to, wheel alignment and balancing, tune-ups, oil changes and other similar normal maintenance items.
- Damage due to improper repairs, warranty or non-warranty, made by persons other than Superior.
Paint finish damage due to improper protection of the paint finish during storage and/or use, rubbing through caused by improper polishing procedures and/or use of improper polishing or cleaning material.
- Cosmetic conditions or surface corrosion from stone chips or scratches in the paint.
- Damage or surface corrosion from the environment such as acid rain, airborne fallout (chemicals, tree sap, etc.), salt, hail, windstorms, lightning, floods, other acts of God, and the like.
- Repairs and adjustments caused by improper maintenance, lack of required maintenance, or the use of fluids other than fluids specified in the Owner's Manual are not covered.
- Repairs and adjustments required as a result of misuse (for example, racing, overloading), negligence, modification, alteration, tampering, disconnection, improper adjustments unless performed by a dealership during warranty repair work or repairs, accident, and use of add-on parts/materials.
- Normal noise, vibration, wear and tear, and deterioration such as discoloration, fading, deformation, or blur are not covered.
- A vehicle which has been damaged to such an extent that the owner or the institution financing, leasing, or insuring the vehicle considers it uneconomical to repair it and, as a result, the vehicle is not repaired by or for the person who owns the vehicle at the time of the event resulting in the damage is not covered by the Warranty. This includes, but is not limited to, those vehicles, which are currently or were previously titled as "scrap", -"salvage", or "dismantled".
- Failure of a vehicle on which the odometer mileage has been altered or changed so that vehicle mileage cannot readily be ascertained.
- Imperfections in body paint, rocker panel paint, exterior moldings and/or decals applied by Superior are normally apparent during new vehicle inspection by the dealer and/or retail customer and are to be corrected at that time. For your protection, we suggest that if you find any Superior-related paint or appearance defects, you report them to your dealer immediately, as normal wear and tear due to use and exposure are not covered by this warranty.
This warranty does not extend to any defect or problem caused by the negligence or acts of purchasers, dealers or others, failure to operate or maintain the product in accordance with the operating and maintenance instructions furnished with each new product, unreasonable use, accidents, alterations or ordinary wear and tear.
4. Remedy:
If, within the applicable warranty period, any part or installation work included in this warranty proves to be defective in material or workmanship, Superior shall, at its option, repair or replace the defective part. Parts and labor shall be at Superior's expense, but not transportation costs.
5. Procedure for Obtaining Performance Under This Warranty:
In order to keep this warranty in effect, the owner must have the vehicle maintained and serviced as prescribed by Superior. You are responsible for keeping maintenance records since it may be necessary in some instance for you to show the required maintenance has been performed. Not all repairs, adjustments and replacements are the result of defects in material and workmanship. There are other circumstances beyond the control of Superior which could cause the body or parts to become damaged depending principally on where and how the owner drives, weather, atmospheric conditions, varying road surfaces, individual driving habits and vehicle usage. In order to obtain performance of the obligations under this warranty, the owner must promptly (in no event later than thirty (30) days after the discovery of the defect) give notice of the defect to Superior or any authorized Superior dealer in the United States or Canada, and at Superior's or the dealer's direction, return the defective part or product to an authorized service center. If repair or replacement by an authorized service center is determined by Superior to be impractical, the owner shall return the defective part or product to Superiors factory at the address stated above. Before performing any work under this warranty, or obligating Superior, dealers must receive prior to authorization from Superior. The judgment of Superior as to the existence of any defect covered by this warranty shall be binding and conclusive upon all parties. Superior reserves the right to make a physical inspection by authorized factory personnel of the vehicle following any complaint.
6. Design Changes:
Superior reserves the right to make changes in the design and material of its products without incurring any obligation to incorporate such changes in any product previously manufactured or advertised.
7. Entire Warranty:
This warranty may be altered only in writing signed by an officer of Superior. It may not be altered or extended orally or in writing by any other person. Superior does not authorize any person to create for it any other obligation or liability in connection with a Superior vehicle.
8. Severability:
Whenever possible, each provision of this warranty shall be interpreted so as to be effective and valid under any applicable law. If any provision of this warranty shall be ineffective only to the extent of such prohibition or invalidity, without invalidating the remainder of such provision or other provisions contained in this warranty.
9. Exclusions and Implied Warranties:
SUPERIOR SHALL NOT BE RESPONSIBLE OR LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, HOWEVER ARISING, INCLUDING BUT NOT LIMITED TO LOSS OF USE OF ANY PRODUCTS, LOSS OF TIME, INCONVENIENCE, OR INCIDENTAL OR CONSEQUENTIAL DAMAGES WITH RESPECT TO PERSONS, BUSINESS OR PROPERTY, WHETHER AS A RESULT OF BREACH OF WARRANTY, NEGLIGENCE OR OTHERWISE. SUPERIOR'S LIABILITY SHALL BE LIMITED SOLELY, AT SUPERIORS OPTION, TO REPAIR OR REPLACEMENT OF THE GOODS OR COMPONENT PARTS NOT MEETING THE QUALITY AND SPECIFICATIONS WARRANTED. NO OTHER WARRANTY, EXPRESS OR IMPLIED, SHALL APPLY, INCLUDING ANY IMPLIED WARRANTY OF MECHANIBILITY OF OR FITNESS FOR A PARTICULAR PURPOSE, AND ANY SUCH IMPLIED WARRANTIES ARE EXPRESSLY DISCLAIMED. IN THE EVENT THAT APPLICABLE LAW PREVENTS THE DISCLAIMER OF ANY IMPLIED WARRANTIES, THEN SUCH IMPLIED WARRANTIES SHALL BE LIMITED TO THE DURATION OF THIS EXPRESS WARRANTY I.E., LIMITED TO FORTY-EIGHT (48) MONTHS OR FIFTY THOUSAND (50,000) MILES ON THE AUTOMOTIVE CHASSIS, WHICHEVER COMES FIRST, FROM THE DATE OF FIRST RETAIL PURCHASE.

Some states do not allow (a) limitations on how long an implied warranty lasts or (b) the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights and you may also have other rights that vary from state to state.
